What To Do If You're Arrested

The Do's and Don'ts While Undergoing Arrest
Do stay silent.
You may think that pleading your case to the arresting officer will help matters, but it will usually only make your situation worse. Anything you say can and will be used against you. The officer is only concerned with making the arrest. His or her opinion on your innocence will have no bearing on your case. Never say anything except, "I want a lawyer."
Do stay calm and polite.
Don't run, resist, or be disrespectful. Keep your hands where police can see them and don't make any sudden movements. You do not want law enforcement to think you are reaching for a weapon, give them any reason to retaliate against you, or add resisting arrest to your list of charges.
Don't consent to any type of search.
If they ask permission to search your car or your home, it means they do not have a warrant to do so. If they discover evidence without a properly executed warrant and you refused consent, there may be the opportunity later to have it thrown out. Also, do not give them any cause to search an area you don't want investigated such as looking over, acting nervous, or attempting to stand in front of the location.
Don't accept an invitation to reenter your home or your vehicle.
If you are arrested in front of your house, law enforcement may give you the opportunity to use the bathroom or say goodbye to a loved one. Don't buy into it! Allowing them to escort you inside your house gives them permission to tear it apart looking for evidence. The same rule applies to your vehicle.
Do ask bystanders to observe.
As long as they don't interfere with law enforcement, bystanders have the right to stay at a reasonable distance and discreetly observe. Do not encourage taunting or berating the officers with questions, but do get the names and contact information of any and all witnesses.
Do get the names and badges numbers of the officers involved in your arrest.
This information is your constitutional right. You also have the right to know the exact charges you are facing.
